§ 55-1. Collection days. [Amended 12-9-1996 by Ord.

Garbage, trash and refuse for residential and commercial properties shall
be collected by the Town according to a schedule approved by the Mayor and
Council which schedule may be changed from time to time as the Mayor and
Council deem necessary.
§ 55-2. Residential and commercial responsibilities.

- Residential accounts.
- The maximum size of private garbage containers shall be 30 gallons,
and all of said private containers shall be equipped with lids, which shall
be closed at all times, except when refuse is being deposited in said containers.
- Plastic trash bags may be used but only if the plastic trash bag is
properly secured so that it refuse will not spill onto the ground.
- All recyclable materials shall be separated from all other refuse as
more particularly set forth in Chapter 81, Mandatory Recycling.
- Any newspapers, magazines or other paper articles defined as recyclable
materials must be secured by string, wire or rope in such a manner as to
create a compact bundle which can be picked up by the Town Sanitation Department.
- No paper bags shall be used for the placement or deposit of refuse,
unless said paper bags are placed in private garbage containers or plastic
trash bags.
- All residential accounts shall provide a location or locations readily
accessible to the Town Sanitation Department, and all private garbage containers,
plastic trash bags or paper bundles shall be placed on the sidewalk in front
of the residence unless otherwise agreed upon by said resident and the Administrative
Director or other proper agent of the Town.
- The Town Sanitation Department shall not be responsible for picking
up any garbage, rubbish or refuse from the ground that is not contained in
a private garbage container, plastic trash bag or paper bundle unless the
Town Sanitary Department causes a spillage.
- Commercial accounts.
- All commercial accounts shall provide a location or locations readily
accessible to the Town Sanitation Department, and the location of all commercial
bins or containers must be approved by the Administrative Director or other
proper agent of the Town.
- The rates for garbage fees for commercial accounts shall be determined
by the Mayor and Council of Berlin, Maryland, annually.
- All fees for commercial accounts shall be due and payable at the time
of rendering of the statement by the Mayor and Council, and the Mayor and
Council reserve the right to deny collection service when, in their sole
judgment, said commercial account is detrimentally in arrears.
§ 55-3. Notice of violation; correction.
- Any person violating the provisions of this chapter shall be notified
in writing by registered mail, return receipt requested, of said violation.
Said notice shall describe the violation and notify the violator to correct
same within five days or for cause shown a greater length of time in which
to correct said violation.
- In the event that the violation is not corrected as set forth in Subsection
A hereof, the Mayor and Council may, at its option, refuse to make collection
of the refuse, trash, garbage, etc., of said violator.

Any person who shall violate any provisions of this chapter shall be guilty
of a municipal infraction and shall be fined the sum of $50 for any single
initial violation and the sum of $100 for each repeat or continuing violation.
