§ 53-1. Adoption of standards. [Amended 4-14-1997 by Ord. No. 1997-7]
The Worcester County Forest Conservation Law, Code of Public Laws of Worcester County, Maryland, Natural Resources Article, §§ NR 1-401 through NR 1-421, is hereby adopted as the Berlin Forest Conservation Law pursuant to the attached agreement between the Mayor and Council of Berlin and Worcester County, Maryland.1 The Department designated by the Board of County Commissioners of Worcester County, Maryland, to administer and enforce the county forest conservation program shall administer the program for the Mayor and Council of Berlin.
1. Editor’s Note: The agreement between the Mayor and Council of Berlin and Worcester County provides the following:
"1. The town, in accordance with § 5-1603 of the Natural Resources Article of the Annotated Code of Maryland, hereby assigns all of its obligations under the Forest Conservation Subtitle of the Annotated Code of Maryland to Worcester County, including, but not limited to all of its program administration, preparation and enforcement requirements.
"2. The town further agrees to abide by the procedures and regulations of Bill No. 94-8 adopted by Worcester County Commissioners pursuant to the county’s obligation under the State Forest Conservation Act.
"3. The town further agrees to coordinate its development approval activities for building permits, site plan approval, subdivision plat approval and any grading and sediment control permits with the requirements of Worcester County.
"4. The town covenants and agrees that no final building permit, site plan, subdivision plat, grading and sediment control permit shall be issued or approved until the applicant has demonstrated compliance with the provisions of Mayor and Council of Berlin and received approval from the Worcester County Department of Planning, Permits and Inspections, as may be required for that activity.
"5. It is understood and agreed that the county shall have the right and authority to fully enforce said Bill No. 94-8 within the corporate limits of the Town.
"6. It is understood and agreed that any and all fees imposed by the County Commissioners of Worcester County for administration of the Worcester County Forest Conservation Program within the municipal boundaries of town shall be retained by Worcester County."
