§ 49-1. Fire zone limits designated.

A new fire zone is established in the Town of Berlin superseding the fire zone established by an ordinance passed on the seventh day of August 1895, which said new fire zone shall be within the following designated limits:

Beginning for said zone at a point at the northwest corner of a vacant lot owned by Dr. R. P. Collins at the intersection of West Street with Main Street and thence following the east side of West Street in a southerly direction to the intersection of West Street and Broad Street; thence in a direct line to the southwest corner of a lot owned by Mrs. Anna Willis at the intersection of Jefferson Street with Gay Street; thence in a direct line to the division line between the residence property of Horace Davis and the residence property of Horace Quillen on the east side of Main Street; thence in a direct line to the division line between the property of W. S. Greenleaf and the property of George Hammond on the north side of Bay Street; thence in a direct line to the division line between the property owned by Mrs. Rachel Hank and the property owned by Mrs. Rosa Rayne on the north side of Pitts Street; thence in a direct line to the north intersection of Vine Street with Williams Street; thence in a direct line to the place of beginning.

§ 49-2. Required materials for building in fire zone.

After the date of the passage of this chapter, no person, persons or body corporate shall build, erect, construct, remodel, repair or maintain within the aforesaid zone limits any dwelling, shop, factory, store or other building or structure unless the same is of brick, stone, hollow tile with stucco face, veneer brick face or concrete blocks. The outer walls thereof shall be at least eight inches thick and the roof thereof shall be of fire-resisting material.

§ 49-3. Permit required.

Any person, persons or body corporate contemplating the erection of any building or structure of any kind or any addition or exterior alteration or repair of any kind on or to any building or structure erected prior to the passage of this chapter shall first file with the Mayor and Council of Berlin at the Town Hall a written application for a permit authorizing such construction, alteration or repair, which said written application shall contain a general statement showing what construction, alteration or repair is proposed and the kind of material to be used. The Mayor and Council of Berlin shall act upon such application with reasonable promptness, and upon approval of such application, the proposed construction, alteration or repair may be stated forthwith. If the application is rejected, the construction, alteration or repair contemplated shall not be undertaken.

§ 49-4. Removal of building.

Any construction, alteration or repair made without a permit as aforesaid and in violation of this chapter may be torn down and demolished by the Mayor and Council of Berlin or its duly authorized servants and representatives, if the Mayor and Council shall in its discretion deem it advisable and for the best interests of the inhabitants of Berlin, and may through its Police Department, injunction or otherwise prevent the said construction, alteration or repair being made in violation of this chapter or compel the removal or demolition thereof.

§ 49-5. Violations and penalties. 1

Any violation of the provisions of this chapter shall be punishable, upon conviction, as a misdemeanor as provided in Article I of Ch. 1, General Provisions, for each day said violation continues.
